Jason W. Hammer and Blair J. Cash Prevail on Summary Judgment in Motor Vehicle Accident Case
Jason W. Hammer and Blair J. Cash recently obtained summary judgment for an insurer in the State Court of DeKalb County. The case arose out of a motor vehicle accident allegedly resulting over $100,000 in past medical expenses for the Plaintiff. Our firm represented plaintiff’s purported underinsured motorist carrier, who Plaintiff served in an attempt to collect benefits under his UM coverage. However, Plaintiff failed to timely notify the insurer of the underlying automobile accident and the alleged claim. Mr. Hammer and Mr. Cash argued that the delay constituted a breach of the notice provisions of Plaintiff’s insurance contract. The Court agreed, granting the insurer’s Motion for Summary Judgment in full, thereby eliminating any liability or exposure to the insurer.
